Diabetic test strips and most CGM sensors are sold over the counter — no prescription is required to buy them, which means no prescription restriction follows them when you sell. Beyond that, a long-standing principle of U.S. law (the “first-sale doctrine”) says that once you lawfully own a product, you’re free to resell it. It’s the same principle that makes selling your used car or your old phone legal.

The Exceptions

When selling is NOT okay

Medicare or Medicaid supplies. Supplies paid for by federal or state programs weren’t fully purchased by you — taxpayers funded them — and reselling them is considered fraud. This is the bright line, and reputable buyers won’t knowingly purchase them.
